Terms of Service
This is a legal agreement between you the “customer” and GRocket (grocket.co). GRocket is a US-based company with physical locations in Texas and Wyoming. Our headquarters is located at 7215 Cameron Road, Austin, TX 78752.
The usage of GRocket as a platform for email marketing and sales automation is governed by the following terms & conditions.
Google’s Limited Use policy
GRocket requires your explicit permission to send email via your Gmail account, or to pull data from Google Sheets. The use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.
No Spam allowed
Spam is any commercial email sent without the recipient’s explicit permission. Commercial email is defined as any electronic mail message whose primary purpose is the commercial advertisement or marketing or promotion of a product or service. Our service is intended to be used for the sole and exclusive purpose of sending messages to recipients who have agreed and confirmed to receive such messages from You. This is called permission-based email marketing. No other commercial use is acceptable and permitted. Other, non-commercial use of the Service is permitted, such as the mailing of transactional messages to individual recipients with whom you or your business have a relationship. Your account may be suspended or terminated if you send SPAM. GRocket is committed to the suppression of Spam and enforces a strict, no-tolerance policy against SPAM, beginning with a customer vetting process based on M3AAWG’s Best Practices and monitoring of account activity.
Code of Conduct
You may never send Spam by using the GRocket platform. Specifically, you may not:
- Harvest emails from web sites
- Send unsolicited marketing emails
- Purchase or rent lists (whether they are opt-in or not)
- Send messages that are unrelated to what subscribers signed up to receive from You
- Add an email address into a list without the subscriber’s permission
- Email someone who has requested to be removed from Your list
- Send messages that violate the United States CAN-SPAM Act, or Canadian Anti-Spam legislation (CASL).
- Send messages that violate the California Consumer Privacy Act (CCPA), or the European Union’s GDPR.
You may send the following types of emails:
- Send a commercial message to a recipient who has double opted-in (or confirmed opted-in) to receive it.
- Send email that has been specifically requested by those who receive it, or that is transactional in nature, such as a password reminder or an order confirmation.
- Send email that is 100% compliant with the United States CAN-SPAM Act, Canadian Anti-Spam legislation (CASL), California Consumer Privacy Act (CCPA), and GDPR.
To avoid the risk of getting blacklisted or in other way accused of sending SPAM, it is crucial that you take the following measures:
- Only send e-mails to contacts that directly and willingly subscribed to receive such communications.
- Never purchase or rent or solicit a list of contacts and/or email addresses from a third-party, under any circumstance.
- Never append email addresses to an existing contact database: email addresses must always and only have explicitly being opted-in.
- Never send any messages to a publicly available list of contacts.
- Never harvest contacts (e.g. e-mail addresses) from the internet.
The following list includes examples of content that is strictly prohibited and in violation of our Terms of Service and Acceptable Use policy.
- Pornography, adult content, escort or dating services, or prostitution services.
- Material that exploits children or discloses personal information of children under 18.
- Materials selling or promoting illegal products, drugs or any controlled substance.
- Material that is grossly offensive, abusive or threatening in any way to the recipient.
- Content that introduces viruses, worms, harmful code and/or Trojan horses on the Internet.
- Content that violates California Consumer Privacy Act (CCPA), and the European Union’s GDPR.
- Content that violates the United States CAN-SPAM Act or Canadian Anti-Spam legislation (CASL).
- Material that encourages violence against any governments, groups or individuals.
- Affiliate marketing or multi-level marketing products and/or services.
- Emails that are any kind of social engineering or phishing attempt.
Required elements on all outgoing emails
We require that each email sent out from GRocket includes a mechanism for subscribers to remove themselves via an unsubscribe link. If a recipient contacts our offices and requests to be removed from a mailing list, we will manually unsubscribe the recipient from our customer’s account and suppress any future emails to that address.
Every email marketing campaign sent through GRocket must contain:
- An accurate and proper subject line, no misleading click-bait.
- A valid Unsubscribe / Opt-out link to all campaigns.
- The sender’s valid postal address and country.
- The sender’s valid phone (optional but highly recommended)
- Appropriate content – please see the code of conduct above.
We also require that each email message comply with United States CAN-SPAM laws, and Canadian Anti-Spam legislation (CASL).
Complaint Response Process
We are here to help our customers maximize the efficiency of their email marketing campaigns, educate them as to the best email practices, and help them to avoid spam complaints. Reporting Violations and Spam
If you receive any email from the GRocket platform that you think is unsolicited, fraudulent or in any way constitutes spam, please do not hesitate to contact us via email – compliance [at] grocket [dot] co. We will investigate every incident and get back to you with a response (or ask you for additional information) within 5 business days.
